LMC Sport is registered in the trade register under the number BE 0760.556.214. Its mailing address is Rue Mitoyenne 295, 4840 Welkenraedt (Belgium) and its e-mail address is info@lmc-sport.com. Any order for a product appearing in the online store at www.lmc-sport.com requires consultation and prior acceptance of these general conditions of sale. Clicking to validate the order implies full acceptance of these terms and acts as "digital sign-off".
All our sales and services are, unless stipulated otherwise, subject to these terms and conditions.
Orders placed by the buyers cannot be canceled without the consent of the supplier. The goods are shipped and travel at the risk and peril of the recipient - even when sold postage. Any transport costs are the responsibility of the buyer. LMC Sport contracts an obligation of means with regard to the delivery period. Any delays do not authorize the buyer to cancel the sale, refuse the goods or services, nor to seek damages. Any complaint relating to any defect in the goods and / or delivery must be issued in writing within a maximum of eight calendar days from the date of delivery. Late complaints will be considered null and void. Complaints do not exempt the buyer from paying the due installments.
The administrative work to establish a purchase order / delivery order / invoice / the discharge in the accounting as well as the packing of the ordered articles costs us on average 10€ per invoice. This is why we are obliged to pass on this cost for orders under 50€ (excl. VAT). For amounts above 50€ we take care of these costs.
LMC Sport retains ownership of the goods delivered until full payment of the price by the buyer. The responsibility for the goods is borne by the buyer upon delivery. The buyer can namely only dispose of the goods after paying their full price. Until then, he commits to not dispose of, encumber or pledge the goods and to keep them in perfect condition.
The invoices of our merchant customers are payable by bank transfer within 8 days of the invoice date. It is also possible to proceed by direct debit (8 days from date of invoice) in order to facilitate transactions and avoid delays or omissions in payments.
Please note that the costs of a refused direct debit are to be paid by the customer. The customer must therefore make sure that his account is well supplied. In case of refusal of direct debit by the customer's bank, the bank charges as well as the sum of the financial discounts corresponding to the invoices not paid at the due date will be re-invoiced to the customer.
All credit and debit card transactions are charged at the time of purchase.
Dynamo Retail (formerly Biretco) customers automatically benefit from the "Gold" commercial status with LMC Sport.
All new customers are required to pay in advance, without discount. The same applies to any invoice issued in the name of a particular customer.
Any unpaid amount at the due date will automatically and without prior notice bear a delayed interest rate of 12% a year until its full payment. In any case the buyer shall owe a fixed and irreducible indemnity corresponding to 10% of the amounts owed for damage and interest. Any delay in payment authorizes LMC Sport to suspend any subsequent deliveries. Any compensation, drawn in particular from a reason for a complaint against LMC Sport, is excluded.
The delivery of goods is subject to the prior approval of LMC Sport's financial department. Deliveries are checked against the current credit limit set specifically for each customer. If the credit limit is exceeded, LMC Sport reserves the right to temporarily stop deliveries until the level of unpaid deliveries falls within the established credit limit.
All products sold by LMC-Sport are covered by a two-year warranty.
LMC Sport only warrants a free re-delivery of defective parts. The warranty is inapplicable in case of: non-conform product installation, abusive, excessive or negligent usage; failure to observe the recommendations for use and maintenance as defined in the technical information manual that the buyer acknowledges having received; normal wear and tear of the equipment; the addition of inappropriate products; an installation that was dismantled, reassembled or repaired by someone other than LMC Sport.
The courts of Eupen and Verviers have sole jurisdiction for all disputes that may relate to sales invoiced by LMC Sport and in particular to entertain an action on a warranty or guarantee or third-party proceedings. The applicable law will be Belgian law.
The possible nullity of one of the clauses of the general conditions does not entail the nullity of the other provisions which remain applicable.
In accordance with the law, the buyer has the right to notify LMC Sport that he renounces his purchase, without penalty and without giving any reason, within 14 calendar days from the day following the product’s delivery date (art. VI .47, § 1, of the Code of Economic Law).
Within this period, the buyer must notify his intention to renounce by sending an e-mail to the supplier’s contact address (info@lmc-sport.com), declaring in an unambiguous manner his decision to withdraw from the contract. He is thereafter obliged to return the product to the supplier’s administrative headquarters (Rue Mitoyenne 295, 4840 Welkenraedt - Belgium) no later than 14 days following the above stated e-mail, at his own expense and risk.
The products must be returned in their original packaging, undamaged, accompanied by all their accessories as well as the original delivery slip. The returned products must not have been unpacked, unsealed or used in any way. Incomplete, damaged, worn down or goods soiled by the buyer will not be taken back.
Subject to the respect of the conditions set out above, the refund will be made at the latest within 14 days of receipt, by the supplier, of returned goods - with the exception of shipping costs.
Under Article VI.53, para. 1, 3 ° to 5 ° of the Belgian economic law code, the buyer cannot exercise his right of renunciation for contracts for the supply of products which: have been tailor-made to the buyer’s specifications or clearly personalized; are liable to deteriorate or expire rapidly; were originally sealed but cannot be returned for health or hygiene-related reasons because they have been unsealed by the buyer after delivery.
The professional customer does not benefit from this right of renunciation.
All personal data necessary for processing an order are kept by the supplier and can be transmitted to companies with which the supplier (or his suppliers) collaborates, when such communication is necessary for order processing.
The buyer also authorizes the supplier to use this data to establish statistics in order to improve his site, the goods and the services he offers.
This information can also be used to allow the dissemination, by any means of communication, of information relating to the commercial activities of the supplier to his customers.
Finally, LMC Sport is allowed to store personal data to facilitate subsequent orders.
Without prejudice to the foregoing, the supplier undertakes not to disclose the personal information in his possession to another company or another business.
